No link between Work-place Stress & CFS

May 2012

The claimant was employed by the defendant as an HR Manager. She alleged that she had suffered work place stress due to working excessive hours and being caught up in a dispute between two senior directors. The stress had weakened her immune system leading her to suffer frequent infections culminating in Chicken Pox, which in turn led to Chronic Fatigue Syndrome (CFS).

The claimant did not return to work after contracting CFS and submitted a £1.25m claim including future loss of earnings until retirement.

Photocard Licences and Driver CPC - Summary

DVLA began issuing photocard style licences to new licence holders in July 1998. These photocard licences also have a paper counterpart on which details of driving offences and other information can be recorded.

The photocard has an expiry date that is usually ten years from the date of issue. At this time the card must be renewed (at a fee) and an up to date photo provided.

Big rises in world oil prices have led to increases in thefts from commercial and domestic premises of fuel oils, such as kerosene and diesel. Nearly two-thirds of UK firms hit by bad weather

Research conducted by Zurich Insurance has revealed that 64% of UK businesses have suffered disruption as a result of adverse weather.

The recent survey, carried out by the insurer in conjunction with the Business Continuity Institute, the Institute of Purchasing and Supply and DHL, showed that adverse weather is the biggest cause of supply chain disruption in the UK, ahead of unplanned outages of IT or telecoms systems.

Home insurance claims are set to rise in the coming year due to the increased number of events taking place this summer, according to research conducted by Axa Personal Lines.

The Olympics, Euro 2012 and the Diamond Jubilee will mean a surge in the number of people holding events in their own homes, and claims data from Axa shows that family get-togethers and parties increases accidental damage and losses. For example, on New Year’s Day 2011 the insurer experienced a 78% increase in losses.

Team Bonding Event not in Course of Employment

The claimant suffered a serious brain injury when he fell from his bicycle after colliding with a colleague during a race organised by his employers, as part of a team-building day.

The claimant was not wearing a helmet even though they were available to any participant who wanted one and expert evidence stated that he would have been unlikely to sustain the injuries he had if he had been wearing one. Motorcyclist jumping the queue found to be 80% liable

December 2011

The defendant car driver was in front of a queue of traffic and attempted to turn right into a car park. As he did so, a motorcycle that had overtaken the traffic queue struck his car resulting in the rider being seriously injured.

At first instance, the car driver was found to be one third liable. He had been unable to see the motorcyclist approaching due to a large vehicle behind him and should have moved towards the centre of the road so that he could see any overtaking traffic in his wing mirror before turning.

Wall Designer charged for childs death

A man who designed a wall which collapsed on a three year old girl, killing her, has been charged with gross negligence manslaughter. The Crown Prosecution Service (CPS) decided that the designer of the wall, which was also constructed by his company, Parcol Developments Limited, should be charged in relation to the death of Meg Burgess on 26 July 2008 in Prestatyn, Wales.

Parcol Developments Limited, of which the charged man was a director, was also charged with an offence under Section 3 of the Health and Safety Act at Work 1974 which requires all employers to conduct their business in a way that ensures, so far as is reasonably practicable, that others are not exposed to risk.

Health Warning Over Dirty Office Desks

Dirty office desks are harbouring germs which can quickly spread among staff as firms are braced for an outbreak of sickness absence through colds and flu, a report said today.

HSE Costs Recovery On The Way

The policy of recovering fees for interventions by the HSE has been agreed by the government. The Health and Safety Executive (HSE) is currently accepting submissions in a three month consultation on the proposed cost recovery scheme for health and safety interventions in order to seek views on the best way of implementing that policy. The deadline for consultation responses is 14 October 2011.

Under the proposed scheme, costs would be recovered by the HSE, if during an inspection or investigation a material breach of health and safety law is discovered and identified by an inspector requiring him to write requesting that the breach be rectified.

Hidden exposures for contracting firms

Construction and contracting firms invariably carry Design & Construction (D&C) Professional Indemnity Insurance (PII). For many disciplines it is compulsory, many clients insist on it, and for all contrcators it is desirable. Frequently contractors who offer no design services at all are being asked to carry professional indemnity. A question they often ask is ‘what risks do I face if I offer no professional services. The answer is that there are some risks:

1. Design alterations: any firm involved in building anything will nearly always need to ‘tweak’ the plans a little in order to make them work. You could call this ‘buildability’ and the problem is that a small alteration here could have a larger knock-on effect, on thus causing a real problem later in the job. A real liability can arise if plans are altered.

2. Design checking services: often firms, formally or informally, double check designs to ensure they work. Failure to do so can lead to a claim.

3. Temporary works: scaffolding, access roads, perimeter fencing, storage facilities are often part and parcel of a contract but are not designed and are left to the contractor. Such works can be expensive and can go wrong leading to further expense and consequential loss.

4. Unsuitability of materials: Contractors may erroneously utilise materials that do not meet the specifications and have not been agreed. This can be very expensive if the materials prove not to be fit for the purpose intended.

5. Duty to warn: a duty to warn the client of any problems or errors that the contractor might become aware of is sometimes included in the contract. Failure to warn when one is aware could lead to a liability and a claim under a PI policy...  more

Whilst few people would purchase a newly built house without expecting the usual 10 year new building warranty, this can’t be said for the developers and ultimate owners of commercial properties if construction defects are discovered within the first 10 years to 12 years.

Commercial developers and property owners in the UK have historically relied on collateral warranties i.e. legal contracts between themselves and the architects, engineers and other construction firms, holding them responsible for any defects in the first six to twelve years after construction.

The problem being this presupposes the architect or construction firm involved will be traceable or indeed still trading when the defect arises and secondly that they have valid and adequate professional indemnity insurance.
